To amend title 31, United States Code, to designate existing authorities for the regulation of the possession, sale, exchange, transportation, distribution, and possession of firearms for lawful purposes by State and local law enforcement officers; to prohibit possession by a person who is a fugitive from justice or any other person who is under sentence of death; to require a firearm dealer licensed under chapter 497B of title 18 to keep a record of records relating to any transaction involving the transfer of a firearm; to ensure that a federally licensed importer, licensed manufacturer, licensed dealer, and licensed collector is trained in the safe handling, storage, and use of firearms and other dangerous devices; to require State and local law enforcement officers to be given discretion when determining whether to initiate a criminal or civil investigation, seizure, or arrest of a person who has been granted or is attempting to obtain a gun under State or local law, unless the officer has reasonable suspicion to believe that the person is a threat to themselves or others; to prevent the possession or use of firearms at a time and place, or for a purpose, when the owner or a responsible person with authority over the person makes a determination that the firearm is likely to be used in a crime; to prohibit the use of a firearm in connection with a criminal or commercial enterprise, when the use of the firearm is contrary to section 1111 of title 18, U.S. Code; to require background checks for purchases or sales of firearms, other dangerous devices, and ammunition at commercial or pawnbroker licensed firearms establishments or federally licensed, federally regulated ammunition merchants; to establish a national instant criminal background check network using data from the federal criminal history record data system and the national instant criminal background check system.
